These General Conditions of B2C Sales, unless derogated by specific written agreement of the parties, apply to all orders sent by EUSPHERA SRL

  1. General provisions

By browsing this area, the user accesses EUSPHERA, which can be reached via the URL www.eusphera.com. Browsing and transmitting a purchase order on the site entail acceptance of the Conditions and Data Protection Policies adopted by the site indicated therein.

These B2C General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree .lgs. n. 21/14 and Legislative Decree 70/039 by

Before accessing products supplied by the site, the user is required to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.

The user is invited to download and print a copy of the purchase form of these general conditions of sale, the terms of which EUSPHERA reserves the right to further modify without notice. It is your responsibility to check this page periodically to stay informed of any changes. Your continued use of or access to the site following the posting of any changes constitutes acceptance of those changes.

By accepting these General Conditions of Sale, the user declares to be of age and to give consent for the use of the site to minors who are under his/her guardianship.

You may not use our products for any illegal or unauthorized purpose, or in violation of any laws in your jurisdiction (including, but not limited to, copyright laws).

It is possible to use the site and therefore access products supplied by it and purchase them in the following languages: Italian, English and Spanish

  1. Object

These B2C General Conditions of Sale regulate the offer, forwarding and acceptance of purchase orders for products from EUSPHERA and do not, however, regulate the supply of services or the sale of products by parties other than the seller that are present on the same site via links, banners or other hyperlinks.

Before placing orders and purchasing products and services from different parties, we suggest checking their conditions of sale.

  1. Conclusion of the contract

To conclude the purchase contract, it will be necessary to complete the form in electronic format and send it following the relevant instructions.

It contains the B2C General Conditions of Sale, the images of each product and the relative price, the means of payment that can be used, the delivery methods of the products purchased, the relative shipping and delivery costs, a reference to the conditions for the exercise of the right of withdrawal; methods and times for returning purchased products.

Before concluding the contract, you will be asked to confirm that you have read the General B2C Sales Conditions including the information on the right of withdrawal and the processing of personal data.

The contract is concluded when the seller receives the order confirmation via e-mail from the user, after verifying the correctness of the data contained therein.

The user will be obliged to pay the price from the moment the online order submission procedure is completed. This will happen by clicking on the “place order” button at the end of the guided procedure.

Once the contract is concluded, the seller takes charge of the order for its fulfillment.

We reserve the right to refuse to provide service to anyone, for any reason, at any time.

  1. Registered users

When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.

Once a registration is made, the user will receive a confirmation email in the emails provided by him. The user undertakes to promptly inform EUSPHERA of any change in their data communicated at any time.

If the user then communicates inaccurate or incomplete data or even in the event that there is a dispute by the interested parties regarding the payments made, EUSPHERA will have the right not to activate or suspend the service until the relevant deficiencies have been rectified.

  1. Product availability

Product availability refers to the actual availability at the time the user places the order. This availability must however be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products could be sold to other customers before the order is confirmed.

Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the user will be immediately informed via e-mail.

If the user requests cancellation of the order, terminating the contract, EUSPHERA will refund the amount paid within 14 days from the moment in which EUSPHERA became aware of the decision of the buyer of the contract.

  1. Payment methods and prices

The price of all products will be that indicated from time to time on the site unless there is an obvious error. In the event of an error, EUSPHERA will notify the buyer as soon as possible, allowing the order to be confirmed at the correct amount or canceled. In any case, there will be no obligation for EUSPHERA to supply what is sold at the lower price incorrectly indicated.

The prices on the site include VAT and do not include shipping costs or any cash on delivery. Prices are subject to change at any time. The changes do not affect orders for which order confirmation has already been sent.

Once you have selected the desired products, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details may be modified before payment.

Payment can be made via:

    1. Credit cards (Visa, Mastercard, American Express);
    2. Debit cards (Visa debit, Mastercad debit);
    3. Afterpay
    4. Bank transfer;
    5. Cash on delivery.

If you buy with Afterpay you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV Srl, related parties and their transferees, and that you authorize such transfer.

  1. Delivery

EUSPHERA carries out shipments throughout the Italian territory, including the state of Vatican City and the Republic of San Marino, in the European Union and non-EU territories.

EUSPHERA will only deliver to the address indicated by the user, provided at the time of purchase.

Delivery is carried out, for Italian territory, generally within 24 – 48 hours, or, if no delivery date is specified, within the deadline estimated at the time of shipment of the delivery method and, in any case, within the maximum deadline 30 days from the confirmation date.

As regards European Union countries, delivery will be made within 48 – 72 hours, and in any case, within a maximum of 30 days.

In non-EU territories, delivery will take place approximately in 5 – 7 days, and in any case, within the maximum period of 30 days.

If delivery is not possible, a notice will specify the place where the order is located and how to arrange a new delivery.

If you are unable to be present at the delivery location, you will be contacted again to agree a new delivery date.

If delivery cannot take place for reasons not attributable to us after 30 days from the date on which

the order is available for delivery, we will assume that you intend to terminate the contract.

As a result of the termination, the amounts will be returned, redelivered with the exclusion of any additional costs deriving from the choice of a delivery method other than the ordinary method offered without unjustified delay and, in any case, within 14 days from the date of termination of the contract. Transport resulting from the termination of the contract may have additional costs which will be borne by the buyer.

Shipping costs are the responsibility of the buyer and are explicitly highlighted when placing the order.

  1. Passage of risk

The risks relating to the products will pass to the buyer from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in relation to them is received, including shipping costs, or at the time of delivery if this occurs at a later time.

  1. Warranty and commercial compliance

The seller is responsible for any defect in the products offered on the site, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian legislation.

In case of non-conformity, the user who has stipulated the contract as consumers will have the right to obtain the restoration of conformity of the products without charge, through replacement, or to obtain an appropriate price reduction or the termination of the contract relating to the disputed goods and the consequent refund of the price.

Some products or services may be available exclusively online through the Website. These products or services may have limited quantities and are subject to return or exchange only in accordance with our Returns and Exchange Policy.

We reserve the right to limit the quantities of products or services we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us.

We reserve the right to discontinue distribution of any product at any time.

We do not guarantee that the quality of the products, services, information or other materials acquired or obtained will be perfectly in line with the user’s expectations, or that the service will be provided without the presence of any errors.

  1. Withdrawal

In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days pursuant to Article 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.

In the event of multiple purchases made by the purchaser with a single order and delivered separately, the 14-day period shall run from the date of receipt of the last product.

The purchaser shall also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or alternatively by sending the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to the withdrawal within a maximum period of 7 days.

The site will carry out the refund using the same payment method chosen by the buyer during the purchase. in the case of payment made by bank transfer, and if the user intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT/BIC necessary to make the refund.

The buyer’s data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy).

  1. Applicable law and competent court

These B2C General Conditions of Sale are governed by Italian law and interpreted on the basis now, without prejudice to any different prevailing mandatory law of the country of habitual residence of the buyer. Consequently, the interpretation, execution and termination of the general conditions of sale are subject exclusively to Italian law.

Any disputes inherent and/or consequent thereto must be resolved exclusively by the Italian jurisdictional authority. In particular, if the user qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile of the same based on the applicable law.
